1. Introduction
These Terms & Conditions (“Terms”) govern your use of services provided by Wendy Jacobs (“we”, “us”, “our”), a certified clinical hypnotherapist operating from 64 Victor Cres, Narre Warren VIC 3805, Australia. By booking an appointment or engaging any of our services, you agree to be bound by these Terms.

2. Our Services
Wendy Jacobs offers the following professional services:
- Hypnotherapy — Clinical hypnotherapy sessions designed to support behavioural and mindset change, including quit smoking and stop drinking programs.
- Quit Smoking Program — A structured program to help clients stop smoking, including the “Free Yourself” guarantee (see Section 6).
- Stop Drinking Program — A structured hypnotherapy program to help clients reduce or eliminate alcohol consumption.
- Coaching Programs — Personal development and mindset coaching programs tailored to the individual client.
- Recovery Programs — Supportive programs designed to assist clients in recovery from various habits or dependencies.
All services are provided for personal growth and wellbeing purposes. They are not a substitute for professional medical, psychological, or psychiatric treatment. We recommend consulting your GP or a qualified healthcare professional before commencing any program if you have existing health conditions.
3. Bookings & Appointments
3.1 Making a Booking
Appointments can be made via our website, by phone on +61 452 119 104, or by email at wendy@wendyjacobs.com.au. A booking is confirmed once you receive a written or verbal confirmation from us.
3.2 Cancellation & Rescheduling Policy
We understand that circumstances change. However, to respect the time of our practitioners and other clients, the following policy applies:
- 24 hours or more notice: Cancellations or rescheduling requests received at least 24 hours before your scheduled appointment will be accommodated at no charge.
- Less than 24 hours notice: Cancellations or rescheduling requests received less than 24 hours before your appointment may incur a cancellation fee of up to the full session fee.
- No-shows: Failure to attend a scheduled appointment without prior notice will result in the full session fee being charged.
Cancellation fees are at the discretion of Wendy Jacobs and may be waived in the event of a genuine emergency at our sole discretion.
3.3 Lateness
If you arrive late to an appointment, the session may still end at the scheduled time so as not to impact other clients. The full session fee will apply regardless of arrival time.
4. Fees & Payment
4.1 Pricing
All fees are quoted and charged in Australian Dollars (AUD). Current pricing for all programs and individual sessions is displayed on our website or provided upon request. Prices are subject to change without notice; however, any change will not affect confirmed bookings already paid.
4.2 Payment Terms
- Payment is required at the time of booking or on the day of your appointment, unless a specific payment plan has been agreed in writing.
- We accept payment via credit/debit card, bank transfer, and other methods as displayed on our booking system.
- Receipts will be provided upon request.
4.3 Refunds
Except as provided under the Quit Smoking Guarantee (Section 6) or as required by the Australian Consumer Law, all fees paid are non-refundable once a session has been delivered. If you are dissatisfied with a service, please contact us directly so we can work to resolve the matter.
5. Client Responsibilities
To get the most from our services and to ensure the safety of all parties, clients agree to:
- Provide accurate and complete health, medical, and personal information at the time of booking and during sessions.
- Disclose any medical conditions, mental health diagnoses, medications, or other relevant circumstances that may affect the suitability of hypnotherapy or coaching services.
- Arrive sober and drug-free to all appointments.
- Engage in sessions with an open mind and a genuine willingness to participate.
- Notify us immediately of any adverse reactions or concerns following a session.
6. Quit Smoking — “Free Yourself” Guarantee
We are proud to offer our “Free Yourself” Quit Smoking Guarantee under the following conditions:
- The guarantee applies to clients who complete the full Quit Smoking program as directed.
- If, after completing the program and attending any required follow-up session(s), you are still smoking, we will provide one additional follow-up hypnotherapy session at no charge.
- If the additional follow-up session does not achieve the desired result, a refund of the program fee may be offered at our discretion.
- The guarantee is void if the client does not comply with all program instructions, misses scheduled sessions without prior notice, or resumes smoking due to personal choice rather than inability to quit.
- The guarantee applies to the original purchasing client only and is non-transferable.
- Wendy Jacobs reserves the right to assess eligibility for this guarantee on a case-by-case basis.
7. Limitation of Liability
To the maximum extent permitted by law:
- Wendy Jacobs makes no guarantee that any particular outcome will be achieved through hypnotherapy or coaching services. Individual results vary.
- We are not liable for any indirect, incidental, special, or consequential loss or damage arising from the use of our services, including but not limited to loss of income, relapse, or failure to achieve a desired behavioural change.
- Our total liability to you for any claim arising out of or in connection with these Terms or our services shall not exceed the total fees paid by you for the specific service giving rise to the claim.
- Nothing in these Terms excludes, restricts, or modifies any right or remedy, or any guarantee, warranty, or other term or condition, implied or imposed by any legislation (including the Australian Consumer Law) that cannot lawfully be excluded or limited.
8. Intellectual Property
All materials provided to you as part of our services — including session recordings (where permitted), workbooks, course materials, and program content — are the intellectual property of Wendy Jacobs and are protected by Australian copyright law.
- You may use these materials solely for your own personal use in connection with the services provided.
- You must not reproduce, distribute, share, sell, or create derivative works from any of our materials without our prior written consent.
- All content on our website, including text, images, logos, and graphics, is owned by or licensed to Wendy Jacobs and may not be copied or used without permission.
9. Privacy
We are committed to protecting your personal information. Our collection, use, and storage of your personal data is governed by our Privacy Policy, which forms part of these Terms. By engaging our services, you consent to the practices described in our Privacy Policy.
10. Governing Law
These Terms are governed by and construed in accordance with the laws of the State of Victoria, Australia. Both parties submit to the exclusive jurisdiction of the courts of Victoria and the Commonwealth of Australia for the resolution of any disputes arising under or in connection with these Terms.
If any provision of these Terms is found to be invalid or unenforceable, that provision shall be severed and the remaining provisions shall continue in full force and effect.
11. Changes to These Terms
We reserve the right to update or amend these Terms at any time. Changes will be effective immediately upon publication on our website. Your continued use of our services after any changes constitutes your acceptance of the updated Terms. We encourage you to review this page periodically.
